A former student is suing the University of Kentucky, alleging she was raped in a UK dorm last year, and claiming UK failed to protect her, according to court documents.
The lawsuit was filed Feb. 13 in the U.S. District Court for the Eastern District of Kentucky, days after the grand jury declined to indict two former students, dismissing the case in a Fayette County court.
The suit claims the university violated Title IX, a federal civil rights law prohibiting sex-based discrimination.
Addison Adkins and Angus Thompson were arrested March 3, 2025, after a former UK student reported to UKPD she had been raped, according to former Kentucky Kernel reporting.
The incident allegedly occurred in Ball Hall on Feb. 18, 2025, and was reported Feb. 22, 2025.
According to Kernel reporting, Thompson, 19, was originally charged with 1st-degree rape and Adkins, 19, was charged with 1st-degree rape and 2nd-degree strangulation.
The complaint said the woman was drinking alcohol with Adkins in his dorm room when Thompson joined them.
The lawsuit claims both men “took advantage of Plaintiff’s inebriated state by sexually assaulting and raping her.”
The woman, who filed the lawsuit, withdrew from classes due to “mental anguish” from the incident, according to the complaint.
The suit said UK had “knowledge of repeated incidents of sexual assault and rape occurring within University-operated residential dormitories” before the students’ report.
UK’s crime bulletin listed six reported cases of sexual assault in 2025, according to former Kernel reporting.
The lawsuit claims university officials knew about the pattern through police reports, campus police data and crime disclosures.
The complaint alleges UK also failed to enforce its “No Alcohol” policy in its dorms.
UK spokesperson Jay Blanton said the university has no comment as a general policy, and they do not comment on pending litigation.
