A judge in Utah decided Wednesday to deny Brigham Young University’s motion to dismiss an open records lawsuit filed by The Salt Lake Tribune.

The Tribune filed the lawsuit after the BYU Police Department provided only two of three open records requests involving students who claimed the school investigated or punished them for reporting sexual assault. 

BYU’s honor code strictly regulates dress, and it prohibits alcohol consumption and premarital sex. Violations can lead to expulsion.

Since the BYU Police Department was established with the help of the state, the newspaper argues that the same transparency laws that apply to state institutions should apply to the BYUPD.
