A Lexington man arrested for the rape and attempted strangulation of a UK student had his case bound to the grand jury and was denied release from home confinement by a Fayette County district judge on Oct. 10.
Chase McGuire, 22, was charged with five counts of 1st degree rape, four counts of 3rd degree sodomy, one count of 3rd degree sexual abuse and one count of 1st degree strangulation (attempted) on Sept. 25, 2024.
The case will be sent to the grand jury where McGuire could be indicted. If indicted, he could face trial.
The conditions of McGuire’s bond require him to appear at every scheduled court appearance, refrain from violating any local, state, or federal law and avoid any contact with the alleged victim or complaining witnesses, according to the conditions of release and judicial decision document.
An interpersonal protection order (IPO) was also placed on McGuire that prohibits him from going near the victim’s residence or the University of Kentucky.
An attorney temporarily representing McGuire told the judge at the hearing he would like to get a job, be allowed to attend church and “other things like that.” McGuire’s attorney said he has fully complied with these conditions and is living with his parents.
McGuire is not currently employed, according to his attorney. McGuire said he was “waiting to see how this was going to go” before starting his job search for warehouse jobs and “local things” in Fayette County.
Assistant Fayette County Attorney Sam Finley said the victim of the on and off-campus assault and rape has “expressed fearfulness” of McGuire.
Due to the “seriousness of the charges,” Fayette County District Judge John Tackett denied the release from home confinement and said current conditions will remain intact.
Thackett said if McGuire is to obtain a job interview date, he may be “willing to allow” him to seek employment.
