Rape and sodomy charges against UK student Patrick Melton Jr. have been dismissed by a Fayette County grand jury, according to the Lexington Herald-Leader.

Melton, 22, was accused of sexually assaulting a woman at his Lexington residence on University Avenue in July 2018.

Melton’s accuser claimed she had been intoxicated and passed out at his residence the night before the alleged assault. Early the next morning on July 6, court records show Melton woke the victim and told her that he wanted to have sex with her.

She said “no” to him several times because she was not on birth control and neither of them had a condom, according to court records. Melton continued his advances and sexually assaulted her, despite her saying “no” and her attempts at pushing him away and escaping.

The grand jury met Tuesday and dismissed Melton’s rape and sodomy charges, according to court documents cited by the Herald-Leader.
