Court rules against seizure of domains

No decision has been made on whether to appeal Tuesday’s court decision in an Internet gambling case, a Justice and Public Safety Cabinet spokeswoman said.

The Kentucky Court of Appeals ruled 2-1 in favor of Interactive Media Entertainment and Gaming Association Tuesday, said Jennifer Brislin, Justice and Public Safety Cabinet communications director. The case came after J. Michael Brown, secretary of the Justice and Public Safety Cabinet, filed a lawsuit on Sept. 18, 2008 to seize the domain names of 141 online gambling sites, she said.

The court ruled domain names are not gambling devices as defined by Kentucky laws and therefore are not subject to seizure by the state, Brislin said.

Brislin said, due to Gov. Steve Beshear’s absence for the presidential inauguration, no decision had been made about what course of action would be taken.
